2. Contractor Responsibility & Independent Use

 

HydraSoy is sold to independent contractors and professionals who are solely responsible for:

• Inspecting roof condition and identifying suitability

• Completing any repairs before treatment

• Safely accessing and working on roofs

• Following dilution, coverage, and application instructions

• Providing accurate information to customers

• Managing customer expectations and warranties

• Ensuring compliance with local laws, safety regulations, and codes

 

HydraSoy does not

 

• verify contractor skill or training

• supervise product use

• control application conditions

• engage in contractor–customer relationships

 

Contractors operate independently and entirely at their own risk.

 

 

3. No Warranty & No Guaranteed Results

 

HydraSoy is provided “as-is” and “as-available.”

HydraSoy makes no warranties, express or implied, including but not limited to:

 

• No guarantee of roof life extension

• No guarantee of specific results or performance

• No guarantee of leak prevention

• No guarantee of waterproofing

• No guarantee of structural improvement

• No warranty of merchantability or fitness for a particular purpose

 

Any statements regarding potential benefits are general expectations, not guaranteed outcomes. Results may vary depending on roof age, condition, climate, application quality, and environmental factors.

 

 

4. Not Suitable for Certain Roofs

 

HydraSoy should not be applied to roofs with any of the following conditions:

 

• Active leaks or moisture intrusion

• Rotting decking or structural weakness

• Severely cracked, curled, or brittle shingles

• Missing shingles or major damage

• Exposed fiberglass mat or extreme granule loss

• Improper previous repairs

• Roofs at end-of-life condition

• Any condition preventing safe application

 

HydraSoy is not responsible for diagnosing roof condition. That responsibility belongs to the contractor.

 

 

5. No Liability for Contractor Use or Customer Claims

 

Because HydraSoy does not control application methods or workmanship, HydraSoy is not liable for:

 

• Improper application or dilution

• Incorrect coverage or spray techniques

• Unsafe roof practices or jobsite accidents

• Roof damage caused by contractor actions

• Customer complaints or dissatisfaction

• Chargebacks, refund demands, or disputes

• Property damage during or after treatment

• Business losses or reputation harm

• Claims arising from promises made by contractors

• Environmental or weather-related effects

• Short-term or long-term roof performance

 

Contractors accept full responsibility for outcomes resulting from use of HydraSoy.

 

 

6. Limitation of Liability

 

To the fullest extent permitted by law:

 

HydraSoy, including its owners, affiliates, partners, and suppliers, shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of:

 

• Use or purchase of HydraSoy

• Application or misapplication

• Contractor business activities

• Customer interactions or disputes

• Any claimed product failure

 

If liability is ever legally required, it is strictly limited to the purchase price of the product only.

 

No other damages may be claimed or awarded.

 

 

7. Indemnification

 

Contractors agree to indemnify, defend, and hold harmless HydraSoy and its affiliates from any claims, damages, legal actions, costs, or attorney fees arising from:

• Contractor negligence or conduct

• Customer disputes

• Roof damage or property claims

• Failure to follow instructions

• Misrepresentation of product performance

 

 

8. Application Safety

 

HydraSoy may make roof surfaces temporarily slippery during and after treatment. Contractors must:

 

• Use proper fall protection

• Follow industry safety practices

• Avoid walking on treated areas until safe

• Exercise caution at all times

 

HydraSoy is not responsible for accidents or injuries.

 

 

9. Product Handling

 

HydraSoy provides general application guidance, dilution recommendations, and best practices. These are informational only and do not constitute professional training or guarantees.

 

Contractors are responsible for proper handling, storage, mixing, and safety precautions.
